Action 471.5 of the criminal code act(1975) states that "a person is guilty of an offence if the person dishonestly uses for postal services a postage stamp that has been previously used for postal service". a person found guilty of such an offence can face a maximum penalty of 12 months imprisoment.

Aust post believes that a purchaser of used and washed stamps,who follows the vendors instructions to "apply gum" and use the stamp to obtain postal services,is breaching section 471.5,and could face prosicution and penalty. a seller of such stamps who falsely represaents them as being able to be used again may be in breach of the trade practices act.
