As you can see in the above photo of the lens (taken with EOS 400D and Tamron 17-50 XR DiII which is a great lens just FYI...), there is a very fine scratch on the lens.

Its very hard to take a photo of such a slight scratch this was the best I could manage, however I can tell you I have taken about 300 photos with this lens and on NONE of them is there any evidence of it being visible. I have studied many sites and there is unanimous agreement that a slight scratch on the top lens (remembering there are many lenses inside the "lens") will not affect image quality. To better understand why, remember the focal length from the camera sensor to the target object is so far beyond the top lens. In any case, someone who knows what they were doing could probably get it finely removed.

UPDATE: I have just uploaded some test images i took of blue sky which is one of the best tests. One of them is shown above (the ones uploaded are 1200x1060 so easier to view). Images taken range from f4.0 to f20 on the camera to give good variation:
